1. General
The following terms apply to agreements with Elsyspas, which is a brand under the company Svenska Badtunnor AB Org 556986-2740, hereinafter referred to as “Elsyspa” or “We”, and apply to the purchase and delivery of goods to customers in Sweden and customers in the countries we deliver to. Elsyspa sells stainless steel spa baths in its physical store in accordance with the Consumer Purchase Act (1990:932) or the Sale of Goods Act for business operators. The conditions below apply to in-store purchases except where exceptions are stated, such as conditions regarding the right of return and returned goods.
Elsyspa also sells stainless steel spa baths through the online store at elsyspas.com, in accordance with the Act (2005:59) on Distance Contracts and Agreements Outside Business Premises, as well as the Sale of Goods Act for business operators. Elsy spa sells to private individuals and companies. Elsy spa also sells custom-made spa baths in various materials and finishes.
2. Prices
Prices are stated in Swedish kronor, SEK or in Euro and include VAT for orders to recipients within the EU. The VAT amount is shown on the order confirmation/receipt. We reserve the right to price increases of materials, VAT adjustments, currency changes, typographical errors, pricing errors, delivery delays, etc. to the extent permitted by applicable consumer rights legislation.
3. Payment Obligation
Placing an order via Elsyspas.com entails a payment obligation. You as a customer accept this payment obligation by accepting our purchase and delivery terms at the checkout step or by approving the quote/order.

Payment by Invoice
When you order in our store or on our webshop, you can pay by invoice or installment payment via Wasa Credit. Wasa Credit and Elsyspa perform a credit check, which in some cases means a credit inquiry is made. We always perform a credit check before we ship your spa. The invoice is issued when the product (or any accessories) is shipped from our warehouse and has a 10-day payment term. For companies, orders outside Sweden or for amounts exceeding 20,000 SEK, we use our own payment terms or credit card/bank transfer. Contact us for more information.
5. Returns and Complaints
In accordance with the Distance Contracts Act, consumers have the right to cancel their purchase within 14 days of receiving the goods without giving a reason. This right of withdrawal does not apply to custom-made goods or goods that have been clearly personalized. For complaints about defects in goods, the three-year consumer right of complaint applies in accordance with the Consumer Purchase Act. You must notify us of the defect within a reasonable time after you discovered or should have discovered it.
6. Warranty
We provide a 5-year warranty on the stainless steel shell and a 2-year warranty on technology and components. The warranty covers manufacturing defects and material defects. The warranty does not cover damage caused by improper use, negligence, normal wear and tear, or external influences such as accidents.
7. Delayed Payment
In the event of delayed payment, we are entitled to charge a late payment fee and interest. If payment is not made after a reminder, the claim may be handed over for debt collection where additional collection costs may be added. For questions about your invoice from Wasa Credit, we refer you to Wasa Credit’s customer service.
8. Deliveries
Normal delivery time is stated on the website for the current period. During periods of high order volume, the delivery time may be extended. We do our utmost to ensure you receive your shipment as quickly as possible. When your spa is ready, you will be notified about delivery. If your order is delayed for any reason, please contact our customer service. Your order may need to be split into more than one delivery, which means packages/goods will arrive with different arrival dates.
Delivery to pickup point
Smaller packages are sent to a pickup point. You will need to show ID when collecting your package. When purchasing accessories or spare parts, a shipping cost is added and will be specified at the time of ordering.
Home delivery
All our larger deliveries within Sweden are made with Schenker or DHL. The included delivery is by regular truck. You need to arrange unloading yourself with a forklift or tractor to get the spa off the truck. Delivery takes place on weekdays 07:00-17:00.
9. Transport Damage
Upon delivery, you as the customer are responsible for immediately inspecting the goods and reporting any visible transport damages directly to the carrier/delivery driver and noting this on the delivery receipt. Hidden transport damages must be reported within 7 days of delivery.
10. Force Majeure
We are not responsible for delays or non-delivery caused by circumstances beyond our control, such as natural disasters, strikes, import restrictions, or other force majeure events.
11. Disputes
If a dispute arises that we cannot resolve through mutual agreement, you as a consumer can turn to the National Board for Consumer Disputes (ARN). For business operators, disputes shall be resolved in accordance with Swedish law with Gävle District Court as the first instance.
